Terms of Use – CASp Preparation Platform

1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of this CASp preparation platform, including all associated websites, subdomains, content, data, materials, communications, and services (collectively, the "Platform"). By accessing or using the Platform in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue all access to and use of the Platform.

2. Educational Purpose Only; No Legal Advice
The Platform is provided solely as an independent educational resource for CASp exam preparation and related study. It does not constitute legal advice, professional advice, regulatory guidance, or any official interpretation of law, regulation, or building code.
No attorney–client, consultant–client, or other professional relationship is created by your use of the Platform. You must not rely on any Platform content as a substitute for consultation with qualified legal counsel, licensed design professionals, or other competent experts. For any project, inspection, report, compliance decision, or legal matter, you remain solely responsible for obtaining and relying on independent professional advice.

3. No Affiliation or Endorsement
The Platform is not affiliated with, endorsed by, sponsored by, authorized by, or in any way officially connected with any governmental or quasi‑governmental agency, board, commission, or department, at the local, state, or federal level. This explicitly includes, without limitation, the California Division of the State Architect (DSA), the Department of General Services (DGS), and any entities responsible for administering the Certified Access Specialist (CASp) program or examination.
All official CASp designations, examinations, trademarks, and publications remain the property of their respective owners and are referenced solely for descriptive purposes. The Platform does not represent official CASp examination content, format, scoring, or policies.

4. Personal Information and Privacy
The Platform may collect and process certain personal information and related data in connection with your access, use, and account, in accordance with applicable law and any separate privacy notice that may be provided. Such information is handled in good faith for legitimate purposes, including operating user accounts, delivering services, improving the Platform, and maintaining security.
You acknowledge and agree that:

Any personal information you choose to submit to the Platform is provided voluntarily and at your own risk.
No system connected to the internet can be guaranteed to be completely secure, and the Platform cannot and does not promise or guarantee absolute protection against unauthorized access, hacking, intrusion, or other malicious activity.
The Platform will use reasonable, good‑faith technical and organizational measures intended to reduce the risk of unauthorized access or misuse of information, but these measures cannot eliminate all risk.
You remain responsible for safeguarding any credentials or information associated with your account, and for promptly notifying the Platform if you suspect any unauthorized access or security incident. The Platform reserves the right, in its sole discretion, to take any lawful action it deems appropriate in response to suspected misuse or security threats, including suspension or termination of access.

5. User Accounts and Conduct
If you create an account, you agree to:

Provide accurate, current information and update it as needed.
Keep your credentials confidential and not permit others to access the Platform using your account.
Use the Platform only for lawful purposes and in accordance with these Terms.
Comply with any applicable policies or rules that may be posted or otherwise communicated in connection with the Platform.

You must not:

Attempt to circumvent or interfere with any access control, security feature, or technical safeguard of the Platform.
Probe, scan, or test the vulnerability of the Platform or any related system or network.
Attempt to gain unauthorized access to accounts, servers, databases, or other resources.
Use the Platform to send malicious code, conduct denial‑of‑service attacks, or otherwise disrupt operations.
Use automated tools (such as bots, scrapers, or crawlers) in a manner that exceeds reasonable, authorized use.

The Platform may, in its sole discretion and without notice, suspend, restrict, or terminate any account or access where it suspects misuse, abuse, hacking attempts, credential sharing, or other security risks, and shall not be liable to you for doing so.

6. Confidential and Proprietary Materials
All Platform content—including questions, explanations, study materials, layouts, designs, structure, data, and compilations—is confidential and proprietary to the Platform owner(s) and/or licensors.
You are granted a limited, revocable, non‑transferable license to access and use the Platform content solely for your personal, individual CASp exam preparation. You must not:

Copy, reproduce, distribute, publish, or publicly display Platform content, except as strictly necessary for your own study use.
Sell, license, or otherwise commercialize Platform content.
Reverse engineer, decompile, or attempt to derive any source code or underlying algorithms from the Platform.
Use Platform content to create competing products or services, train models, or replicate substantial portions of the Platform.

Any unauthorized use or disclosure of Platform content may result in immediate termination of your access and may give rise to civil and/or criminal liability.

7. "AS IS" Disclaimer and No Guarantee of Results
To the fullest extent permitted by law, the Platform and all content are provided "AS IS" and "AS AVAILABLE," without any representations, warranties, or guarantees of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.
Without limiting the foregoing:

The Platform does not warrant that any content is accurate, complete, current, reliable, or free of errors or omissions. Codes, standards, regulations, and exam content may change without notice.
The Platform does not guarantee any particular exam result, certification outcome, employment opportunity, contract award, inspection result, or other professional benefit. Your success depends on your own effort, preparation, and judgment.
The Platform does not warrant that access will be uninterrupted, timely, secure, or free from defects, viruses, or other harmful components.

You assume all risks arising from your use of or reliance on the Platform.

8. Limitation of Liability
To the maximum extent permitted by the laws of the State of California, USA, in no event shall the Platform owner(s), operator(s), contributor(s), or any affiliated or related parties (collectively, the "Released Parties") be liable to you or any third party for any:

Indirect, incidental, consequential, special, exemplary, or punitive damages of any kind;
Loss of profits, loss of data, loss of business, loss of goodwill, or personal injury;

arising out of or in connection with:

Your access to or use of the Platform;
Your inability to access or use the Platform;
Any reliance upon Platform content;
Any error, omission, interruption, defect, delay, or security incident;
Any unauthorized access, hacking attempt, or breach that is not directly and solely caused by the Released Parties' intentional misconduct.

If, notwithstanding the above, any Released Party is found liable to you, such liability shall be strictly limited, in the aggregate, to the amount you actually paid, if any, for access to the Platform during the twelve (12) months immediately preceding the event giving rise to the claim.

9. Indemnification
You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, suits, proceedings, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to:

Your access to or use of the Platform;
Your violation of these Terms or of any applicable law or regulation;
Your violation of any rights of another person or entity;
Your misuse or unauthorized disclosure of personal information;
Your reliance upon or misuse of any Platform content.

This indemnity obligation shall survive termination of your access to the Platform.

10. Modifications, Suspension, and Termination
The Platform is under no obligation to update, maintain, or continue to provide any specific content, features, or services. The owner(s) may, at any time and without notice:

Modify these Terms;
Change, add, or remove content;
Suspend, restrict, or terminate the Platform or any portion thereof;
Suspend, restrict, or terminate your individual access for any reason or no reason.

It is your responsibility to review the then‑current Terms each time you access or use the Platform. Continued use after any modification constitutes your acceptance of the modified Terms.

11. Governing Law, Jurisdiction, and Severability
These Terms and any dispute arising out of or relating to the Platform shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict‑of‑laws principles.
Any legal action or proceeding relating to the Platform or these Terms shall be brought exclusively in the state or federal courts located within the State of California, and you hereby irrevocably submit to the personal jurisdiction of such courts and waive any objection based on forum or venue.
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.

12. Entire Agreement
These Terms constitute the entire agreement between you and the Platform owner(s) with respect to your access to and use of the Platform and supersede all prior or contemporaneous communications and understandings, whether written or oral, regarding the subject matter herein.
